Course: Pleas in Mitigation and Sentencing

The plea of mitigation is the opportunity for the defendant's advocate to persuade the court to impose the most lenient sentence it is reasonable to impose in the circumstances of the offence and of the offender. This Course will discuss practical steps on how the plea in mitigation should be prepared and properly presented.

This course consists of two Lessons:

In the first Lesson you will learn:
  • the definition of a plea in mitigation

  • what are common mitigating factors

  • the different situations in mitigation

  • how to approach the plea in mitigation

  • how to adapt the plea in mitigation to the offence committed

  • how to prepare the plea in mitigation

In the second Lesson you will learn:

  • the definition and types of custodial and non-custodial sentences

  • the concept of a suspended sentencing guidelines

  • how to advise the client in mitigation

  • how to present your client and yourself to the court

  • the various mistakes in mitigation that should be avoided

  • the definition and types of plea bargaining

  • how to challenge facts after a guilty plea


Francis Burkett
Barrister-at-Law


Francis is a Barrister-at-Law admitted in England & Wales and in Hong Kong. Before coming to Hong Kong, Mr. Burkett was in private practice in the UK for over 20 years.

He was an Associate Professor in the School of Law at City University from 1997 - 1999, and has taught extensively both overseas and in Hong Kong, including Criminal Procedure on the Overseas Lawyers Preparatory Courses.

Now in private practice in Baskerville Chambers, Mr. Burkett's areas of practice include both criminal and civil.
