The "inherent jurisdiction" is a difficult idea to pin down. There is no clear agreement on what it is and what it can be used for. While the debate continues, the inherent jurisdiction has become the foundation of a whole armory of judicial powers used by courts to ensure the observance of the due process of law, to do justice between the parties and to guarantee a fair trial between them.

This Course consists of two Lessons:

In the first Lesson you will learn:
The concept of inherent jurisdiction, including its key features
The juridical basis of the inherent jurisdiction
About some important cases that serve to define the "limits" of such jurisdiction
In the second Lesson you will learn:
The rationale behind the court’s rule-making power
How this rule-making power relates to the inherent power of the court
The common law interpretation of the court’s power to make Rules of Court
About recent HK cases which show the variety of circumstances the inherent jurisdiction can be used

David M. Quick, QC
Visiting Associate Professor, School of Law, City University of Hong Kong

David Quick was admitted in South Australia in 1970. He then worked as a Barrister and Solicitor for a law firm until 1977, when he moved to the practice Bar and practised as a Barrister.

During that time he has held several legal appointments with the Australian Defence Force including Defence Force Magistrate and Judge Advocate.

He was appointed Queen's Counsel in 1984.

In addition to the practice of Law, he has held teaching positions as Lecturer in the Department of Legal Education, HKU (1989/90) and at Adelaide University. Mr Quick is currently a Visiting Associate Professor at the School of Law, City University of Hong Kong.
