Course: Actions for Professional Negligence

Prior to 1932, there had been no unifying principle in determining negligence. Although the law had long recognised a large number of specific situations in which a duty of care exists, liability was recognized in only a few defined situations. After Donoghue v. Stevenson and subsequent cases, the scope and number of cases involving professional negligence have expanded dramatically.

This Course on Actions in Professional Negligence consists of three Lessons:

In the First Lesson you will learn about:
  • the different factors that have led to the expansion of liability

  • the underlying principles of duty of care in Donoghue v. Stevenson

  • the expansion of liability from consumers to third parties

In the Second Lesson you will learn about:

  • the concept of duty of affirmative care

  • specific instances where duty of care exists in professions

  • the duty of care required of public authorities

In the Third Lesson you will learn about:

  • the different situations of concurrent liability with negligence

  • the concept of contributory negligence

  • the relevance of acceptable professional practice


David M. Quick, QC

Visiting Associate Professor, School of Law, City University of Hong Kong

David Quick was admitted in South Australia in 1970. He then worked as a Barrister and Solicitor for a law firm until 1977, when he moved to the independent Bar and practised as a Barrister.

During that time he has held several legal appointments with the Australian Defence Force including Defence Force Magistrate and Judge Advocate.

He was appointed Queen's Counsel in 1984.

In addition to the practise of Law, he has held teaching positions as Lecturer in the Department of Legal Education, HKU (1989/90) and at Adelaide University. Mr Quick is currently a Visiting Associate Professor at the School of Law, City University of Hong Kong.
