Course: New Territories Conveyancing
Code: LP03_C27
Duration: 3 hours
CPD Credit: 3 CPD Points

For a practitioner unfamiliar with New Territories (or NT) matters – in particular its customs, laws and bureaucratic practices – it is like going quite literally into a "new territory" insofar as conveyancing work is concerned. Conveyancing belongs to the somewhat arcane practice of NT land law and as such differs from that applicable to “urban” areas, where titles to land are normally deduced with relative ease following a set of standard procedures.

This Course, New Territories Conveyancing, aims to help you understand why such a difference exists.

A host of problems affects conveyancing practice in the NT. Some of the problems are historical in origin (i.e., treaties, proclamations, inaccurate land surveys, deep-rooted Chinese customs), while others can be traced to politics (i.e., administrative practices of the former New Territories Administration and legislation applicable in particular to the NT).

The Course consists of two lessons on the following topics:
  • History of the NT, inaccurate land measurements, Crown leases, housing grants, changes in land use, and documentation problems

  • Chinese customs -- especially on succession and inheritance -- and their imprint on the NT’s ordinances
